Worldwide, MLI projects that 1,500 laser hair removal systems will be sold this year, generating about $120 million in revenues for these manufacturers. This sales volume is expected to increase to 1,800 units in 2000, albeit at lower average selling prices due to competitive pressures. In terms of an installed base of customers, ESC Medical Systems (Needham, Massachusetts) has the largest number of units in the field. ESCs hair removal system customer base is estimated at 600 units. However, Candela (Wayland, Massachusetts) produces the greatest sales volume at this time, due to an extremely successful alexandrite laser product with cryogen cooling. Candelas installed base is approximately 500. Coherent Medical (Santa Clara, California) offers another best-selling hair removal laser. About 375 of these LightSheer diode laser systems have been shipped over the past 18 months.

The American College of Obstetricians and Gynecologists has issued a committee opinion (similar to a position statement) on vitamin A supplementation during pregnancy. The statement urges that it is essential that obstetrician-gynecologists recognize the possible health hazards of excessive use of vitamin A supplements prior to conception or during early pregnancy. Concerns have been raised in Europe about the possibility that a pregnant woman might obtain a potentially teratogenic dose of vitamin A by eating liver. Some samples of calf liver from Europe have been found to contain extraordinarily high levels of vitamin A. Retail samples from US markets, however, appear to contain much lower levels of the vitamin and would not be expected to be toxic. Because dietary vitamin A intakes in the US are generally adequate, routine vitamin A supplementation during pregnancy is not recommended. If supplements are taken, a dose of 500 IU/day should be considered the maximum intake prior to and during pregnancy. Most prenatal vitamin preparations contain 5000 IU or less, but some over-the-counter products contain 25,000 IU or more. Women who are or may become pregnant and who are using high doses of vitamin A supplements should be cautioned about the potential teratogenicity.
Some research has shown that daily consumption of multivitamin supplements by HIV-infected pregnant women resulted in significant reductions in the risk of LBW, severe preterm birth and fetal loss and also improved the immunologic profile of the mothers. In another study, vitamin A supplementation during pregnancy was found to reduce the risk of preterm delivery among HIV-infected women. To investigate this topic further, a recent study examined the effects of multivitamin and vitamin A supplements on weight gain during the pregnancy of HIV-infected women. Between April 1995 and July 1997, pregnant women who were receiving prenatal care and tested positive for HIV infection at one of four clinics in Tanzania were invited to participate in the study. Each woman was assigned to one of four regimens: multivitamins (thiamine, riboflavin, niacin, folic acid, and vitamins B-6, B-12, C and E), vitamin A, multivitamins including vitamin A or placebo. The women took these oral supplements daily and were weighed monthly until the end of their pregnancy. The results are based on a sample of 957 women. The estimated average rate or weight gain during the second trimester was 306 g/week and was significantly higher than that of the third trimester, 247 g/week. Supplementation with multivitamins significantly increased weight gain during the third trimester and also showed a positive effect on the rate of weight gain particularly after week 26 of gestation. By week 36, mothers receiving multivitamins were gaining an average of 39 g/ week more than women not receiving multivitamins. During the third trimester, multivitamin supplements resulted in significantly reduced risks of low total weight gain, weight loss and low rate of weight gain. Vitamin A supplements did not have a significant effect on weight gain outcomes overall or during the third trimester. However, there was a positive, significant interaction between vitamin A supplements and multivitamins during the second trimester. Women receiving both supplements had a 29% lower risk of low total weight gain than did women who received multivitamins alone.
An editorial in the British Medical Journal has briefly reviewed the evidence on the importance of two vitamins during early pregnancy — folic acid, which can prevent some birth defects, and vitamin A, which can cause birth defects if consumed in excessive amounts. It is now accepted that vitamin A in sufficient doses is teratogenic in humans, although its carotenoid precursors are not. A recent human study has suggested that the maximum safe dose of vitamin A may be no higher than 10,000 to 15,000 IU/day. Although this conclusion has been widely challenged, it seems sensible to err on the safe side until further work is done. The author of this editorial, who is Director of the International Centre for Birth Defects, recommends that women who are planning a pregnancy or have very recently become pregnant should seek medical advice about using supplements. The simplest course of action is to take only folic acid at a dose of 0.4 mg/day. Women who wish to take multivitamins should be sure that their supplement contains between 0.4 and 1.0 mg/day of folic acid and not more than 5000 IU/day of vitamin A.

The ball-on-rod rolling contact fatigue (RCF) tester (1) is an element tester which is used to evaluate the RCF properties of materials, primarily steels, for bearing applications. In order to produce test results in a reasonably short period of time, the load imposed on the steel test rods is much higher than that typically experienced in actual bearing applications. The standard test condition, set forth by Glover (2J, results in a calculated Hertzian contact stress of 5.4 GPa. This high contact stress causes plastic deformation of the test rods. In addition to the ball-on-rod RCF Tester, many other accelerated RCF test rigs use high contact stresses to reduce test time. For example, the flat washer tester is operated at a contact stress of 4.1 GPa (3), the Rolling Contact (RC) rig at 5.4 GPa (4) and the Ball on Cylinder rig at 5.9 GPa (5). While these machines and test conditions are widely used, the use of the high stress conditions have been questioned as being too high for correlation to full-scale bearing tests that are commonly in the range of 2 - 2.7 GPa (300 - 400 ksi) (6)-(8). Zwirlein and Schlicht (6) felt that tests performed at high stress levels can lead to improper conclusions on how a material will respond at lower stress levels. The deformation occurring at the higher stress levels was felt to alter the residual stress state of the material and thus, influenced the test results. Lorosch (7) felt the plastic deformation occurring at the higher stress reduced the life exponent, compared to that obtained at lower stresses. Thus, data generated at contact stresses that created plastic deformation could not be compared to that generated at lower contact stresses.

School bus-related crashes killed 164 persons and injured an estimated 18,000 persons nationwide in 1999 according to the National Highway Traffic Safety Administration. Of the persons injured in school bus related crashes from 1994 to 1999, about 44% were school bus passengers, 9% were school bus drivers, and another 43% were occupants of other vehicles.

Monday May 5, 2003 will go down in history as a day to remember in employment law. It was the day the long-debated amendments to the Health Safety in Employment Act finally came into effect. Why is this new legislation so important? The term “workplace stress” took on a whole new significance, with new obligations for employers, and potentially serious financial consequences for those who ignore them. Workplace stress is no longer simply a sad fact of life. It is now an officially recognised and legislated “workplace hazard”, with the amendments extending the definitions of “harm” and “hazard” to include physical and mental harm caused by work-related stress. A cursory reading of the new legislation might be enough to instantly treble employers workplace stress, but a deeper understanding goes some way to restoring mental equilibrium. The Occupational Safety and Health booklet, Healthy work, Managing Stress in the Workplace, tells employers that “there is only a requirement to manage work stressors or the individuals stressed situation where you can be reasonably expected to know about the stress. Even then the obligation is only to do what is reasonably practicable in the circumstances.”

TRAIN users face more commuter chaos after drivers threatened a series of 24-hour strikes over safety. The 190 staff with Thameslink, which operates services in London, East Anglia and the Midlands, are protesting against single-operator trains without guards, which they claim put passengers at risk. Simply put, the intention of this legal reform is to simplify the law and to improve accessibility for all by streamlining procedures in response to the public. Alberta Justice, through its Family Law Reform Project, initiated a review of all provincial family laws following a series of public consultations, primarily in Edmonton and Calgary. Family law problems are inherently complicated and in Alberta, in addition to legal issues, procedural issues–both systemic and jurisdictional–have long frustrated efforts to resolve cases. Some family law problems, such as divorce, spousal support, and child support, are matters of federal jurisdiction, governed by the laws of Canada. Others, such as the division of matrimonial property and custody or access orders in non-divorce or common-law situations, are said to be matters of local and provincial concern and are governed by provincial laws. While legislative jurisdiction is a topic that does not really interest anyone other than lawyers, it is something that, in Alberta at least, has confused and frustrated members of the public, since it determines which court deals with which issues. As a rule, matters arising from federal statutes must be dealt with in courts of superior jurisdiction–in Alberta, this is the Court of Queens Bench–while matters arising from provincial legislation are generally, but not exclusively, matters for the lower level provincial courts. For years, the public has had difficulty determining which court is the appropriate court for a particular problem. In addition, there has been significant concern in the past over jurisdictional abuses, including forum shopping and the unnecessary duplication of proceedings in both levels of court. Sometimes this occurs at the initiative of lawyers themselves, but it is also common on the express instruction of clients. Clients unhappy with a lower court decision may want a second kick at the can in the higher level court. Applying for the same or similar relief in a higher level court is a de facto appeal of the lower level decision, without meeting the formal requirements for an appeal in law. While members of the Alberta judiciary frown on it, whether at the behest of lawyers or clients, such conduct has been frustrating to contend with over the years.
Why do we concern ourselves with such things? The concept of the contract allows people to make commitments between themselves that the state will enforce–the result being future stability of relationships, avoidance of conflict, and general societal harmony. How odd, then, to apply these concepts to family law! It might fairly be said that the whole of family law concerns itself with addressing members of society where relationships are no longer stable, where conflict abounds, and where harmony has ceased to exist. The concept of family, I think, arises only in the context of some directly stated or some implied commitment. A husband promises to share his life with his wife. Beyond the formal commitment of marriage, separate or same-sex couples can likewise expressly, or by implication, promise to share their lives with their partners. Parents promise to care for and support their children. Each of these commitments could be said to be some form of express or implied commitment between people.

Bankers and recruiters give their perspectives on recruiting and hiring the best. “Were very optimistic that some new opportunities will come out of that transaction,” Lapera said. If so many other acquisitions of smaller banks by major regional or national banks are any indication, the PNCMercantile deal will probably frustrate some number of Mercantile staff members, including commercial lenders, if only because PNC is bound to do something differently, something that diminishes someones stature. Lapera would simply like to tailor his pitch to whatever exactly it is that causes dissatisfaction, though he expects that it will relate to additional reporting layers commonly found at larger banks and the relative difficulty that an individual has making a real difference at a larger institution. Its a big issue for Lapera and his counterparts at community banks across the country. Frederick County Bank, has $223 million in assets and was launched in 2001 mainly to serve a business market. At the same time, traditional thrifts arc moving into commercial business, out of recognition that they need to expand beyond savings accounts and residential lending and because they see fee revenue and interest income opportunities in serving businesses that are willing to pay for personal attention.
Commercial lending is frequently thought of as one of the few remaining unregulated business activities, free from the plethora of laws and regulations that place numerous restrictions on other financial services businesses. Many commercial lenders would be surprised, however, at the number and variety of rules applicable to commercial lending activities. Following is a brief review of key laws and regulations which have potentially significant implications for commercial lenders. (References to “banks” below generally includes thrift institutions unless otherwise noted.) ECOA prohibits discrimination in the extension of credit on the basis of race, color, religion, national origin, gender, marital status, age (provided the applicant has the capacity to enter into a contract), because all or part of an applicants income is derived from a public assistance program, or because the applicant has exercised a right under the Consumer Credit Protection Act. The Act applies to all types of consumer and business credit transactions, although it has a limited impact on public utilities credit, securities credit, incidental credit and government credit. To ensure compliance with ECOA, commercial lenders must have an effective nondiscrimination policy, adopt procedures and forms for providing notice of “adverse action” (e.g., a denial of or counteroffer to a loan application or an unfavorable change to an existing credit), ensure that marketing efforts cover all geographic segments of the market and, if they make multifamily housing loans (including for construction, development, or rehabilitation), post Equal Housing Lender notices in publicly accessible offices (including offices adjoining a bank branch office). In addition, commercial lenders should ensure that sales, marketing and underwriting staff understand the concept of “disparate impact,” under which the critical issue is not whether discrimination was intended but whether the effect of a lenders act or practice was discriminatory.

Prosperity in the U.S. construction industry was again on the house, as the residential segment continues to exhibit most of the recent growth in the domestic building industry. The construction industry appears to be hovering at a level close to last years pace, says Robert A. Murray, vice president of economic affairs for McGraw-Hill Construction. Housing remains very healthy, and the upturn for non-residential building in February was a welcome development after a sluggish January. Murray says that higher steel prices could be putting a crimp in the nonresidential segments. Over the course of 2004, its expected that nonresidential building will see a modest strengthening trend. Admittedly, though, this years sharp increase in steel prices has made the nonresidential upturn less certain, given the impact that higher costs and materials shortages may have on individual construction projects. At this juncture, it appears that the nonresidential upturn will be dampened but not derailed, assuming steel prices settle back by midyear, but the situation clearly bears watching.

House Bill 655 has been referred to the House Environmental Matters Committee in Maryland. The devastating effect Sexton mentions not only damages efforts to introduce youngsters to hunting, but it also will impact the states economy.

OREM — Brooks Shankle, the Orem Owlz reserve first baseman, hasnt had many chances this season to deliver a game-winning hit. And playing in only 15 of Orems 37 games, he also has had much need for redemption. But for a short time Saturday he was looking like the goat after dropping a throw from pitcher Aaron Cook in the eighth inning, an error that resulted in a key run for the Idaho Falls Chukars and had the game knotted heading into Orems final at bat. Shankle entered the game hitting only .170 and was hitless Saturday prior to the clutch game-winner. It was only his third RBI of the season.

WASHINGTON (Bloomberg) — U.S. sales of new homes rose in October to the highest level in three months as low mortgage rates and stock market gains rejuvenated housing activity. “The market is going to remain as strong as its been, which is an incredibly healthy home buying market,” said Lori Steiner, senior vice president of marketing at Dominion Homes in Dublin, Ohio. A rebound of new home sales in the West accounted for the October increase, as sales fell in the other three regions. Including sales of previously owned homes, “the housing market is going to set a third consecutive record this year,” said David Berson, chief economist at Fannie Mae, the worlds leading buyer of single-family home mortgages. Home sales next year “will be extremely strong.”

Construction of a sewage plant in the unincorporated San Luis Obispo County community of Los Osos has been halted following the successful recall of three elected officials who supported the plant. The reconstituted CSD board halted construction and dismissed the agencys general manager, attorney and public information officer. Board members have indicated they would pursue a different type of treatment plant to be built outside of town. Indirectly, the board has picked a fight with state agencies that have been working for years on water quality improvements State regulators have insisted since the 1970s that Los Osos needs a wastewater treatment facility. The town of 14,000 people relies on 6,000 individual septic systems, which regulators blame for polluting the groundwater and Morro Bay estuary. A state-imposed building moratorium has been in place since 1988.
Civil engineering construction continued to increase in the third quarter. The value of construction put in place in this segment of construction was 26.2% higher than a year ago. A year-on-year decrease was recorded only in the construction of residential buildings (see table). In interpreting the value of construction put in place, we note that these figures exclude the activity of smaller firms (see note below table), whose main activity is estimated to be residential construction. According to seasonally adjusted data, activity increased relative to the previous quarter only in civil engineering, whereas activity in residential construction was at its lowest point in the last two and a half years. The growth of employment in the construction sector continued. In the nine months to September, the number of employees surged by 11.0%. As in 2006, the highest increases in employment were recorded in general construction and building completion. The share of firms that were unable to find workers declined in November after Octobers record-high value. According to business trends in construction, 47% of enterprises (employing 52% of workers) reported “shortages of skilled workers” as a limiting factor in November. This figure is smaller than in the previous two months, but still well above the average value of this indicator in the last five years (since data have been available).
CONSTRUCTIONFor those companies that decide to expand via new construction, the experience can be an unsettling one, full of uncertainties. In fact, relatively few startup businesses choose construction as their mode of entry due to the higher costs associated with it and the greater length of time involved from the breaking ground stage to the day when the establishment opens its doors for business. Small- and mid-sized businesses, however, are far more likely to have the financial wherewithal to launch a new construction project. Such firms have a proven track recordwhich can help them with financingand already-productive operations that bring in revenue that can be used to defray the costs of construction.Owners of these businesses, however, should fully weigh the advantages and disadvantages of construction before moving forward. As the J.K. Lasser Institute indicated in How to Run a Small Business, Building has the advantage of giving you the space and arrangements which meet your needs, providing you know specifically and objectively what the needs are. The obvious disadvantages are the delay in occupancy while land acquisition, design work, and building are going on, and the cost of overruns and mistakes caused by forecasting errors and planning oversights.

When youre the smallest kid in the class it helps to have a few tricks up your sleeve. But now the skills that Steven Frayne, 23, used as a schoolboy in Bradford to keep the other kids off his back and himself out of trouble are paving his way to stardom. He was brought up by his mother and rarely saw his father. He was also diagnosed with Crohns disease, a chronic stomach condition, as a child. But now, global fame beckons for Dy-namo, who has signed a major deal with Warner Vision International for the worldwide distribution rights to his next DVD, scheduled for release this November. He is also the star of the video “Hands”, the new single from the Raconteurs, out today. It seems that Dynamo, often referred to as Britains answer to David Blaine, will soon be rivalling the Americans success. Senior vice-president of Warner Vision International, Frank Brunger, said that they would also produce a TV version of the production and distribute it digitally. “We were attracted to work with Dynamo simply because of his talent and the effect it has on other people. He came and did some magic here in our offices and all the staff were gobsmacked,” he said.
Having been sadly absent from the stand-up circuit for some years, he now returns with “Card Tricks and Close-up Magic”, a show which puts centre- stage his wondrous magic skills. “Magic is a phenomenal art form,” Sadowitz enthuses. “There is great discipline, science and creativity to it. In a small theatre with tiered seats, genuine close-up magic is something that isnt just the stuff that Paul Daniels and co have been trotting out for years.” He has little time for grandiose magicians. “Theyve helped to make magic irritating to the public,” Sadowitz reckons. “People dont like being fooled. Magicians should come clean and get rid of the patter. When magicians get over-dramatic like David Copperfield, thats just insulting the audience.” His show is much more pared-down. “I like to take a back seat and cut out the waffle. I want the tricks to speak for themselves. Theres a lot of ghosts in my show - magicians from the past saying to me, `Dont make a mistake, thats my trick.” Stand-up generally takes a back-seat in this show, although Sadowitz admits that “It does seep out occasionally. The comedy side of my brain wants to say something while the magic side is saying, `This is not the time or the place. I try to resist out of respect for the tricks, but Im not succeeding totally.” Faint-hearted audiences should be warned that Sadowitz has not ruled out a full-time stand-up comeback. “I put everything on the line for my comedy,” he asserts. “If I was going to do it again now, it would be a lot more offensive because Ive had five years in abeyance. Ive suppressed a lot.
